1. Overview

AI Backyard Designer (“the App,” “we,” “us,” or “our”) is an AI-powered design application that allows users to upload or select images of outdoor spaces and generate backyard design concepts.

By using the App, you acknowledge the practices described in this Privacy Policy. We process only the information reasonably necessary to provide, maintain, secure, and improve the App.

2. Information We Process

Images and User Content

When you choose to use the App's AI design features, you may provide photos of backyards, gardens, patios, pools, homes, or other outdoor spaces. You may also provide text prompts, design preferences, selected styles, and other instructions.

The App accesses your photo library or camera only after you grant permission through iOS. You may revoke these permissions at any time in your device settings.

Generated Content

We process AI-generated images and related design results so they can be displayed, downloaded, saved, or shared at your direction.

Technical and Usage Information

Depending on the services and software components used in the App, limited technical information may be processed, such as device type, operating system version, app version, language, general usage events, crash information, diagnostics, and performance data.

Support Communications

If you contact us, we may receive your email address, the content of your message, and any information you voluntarily provide.

3. How We Use Information

We may use information to:

• Provide AI-powered backyard design and image transformation features.
• Process prompts, images, style choices, and generated results.
• Operate, maintain, troubleshoot, and improve the App.
• Detect abuse, fraud, security threats, or technical failures.
• Respond to support requests and communicate with users.
• Manage subscriptions, entitlements, and premium feature access.
• Comply with applicable legal obligations and enforce our terms.

We do not sell your personal information. We do not use uploaded backyard images for targeted advertising.

4. AI Image Processing

To generate backyard designs, images and prompts you submit may be securely transmitted to third-party AI processing providers acting on our behalf. These providers process the content to create the requested output.

Uploaded images may contain visible details such as buildings, property features, people, license plates, addresses, or other personal information. You should avoid uploading images that contain sensitive or unnecessary personal information.

You represent that you have the right and permission to upload and process the content you submit. You retain your rights in your original content, subject to the limited processing necessary to operate the App.

We do not authorize service providers to use your submitted content for unrelated advertising. Their processing may be governed by contractual terms and their own privacy and security practices.

5. Sharing and Service Providers

We may share or make information available only as reasonably necessary to the following categories of recipients:

• AI processing providers that generate or transform images based on your instructions.
• Cloud hosting and storage providers that support secure delivery, temporary processing, and operation of the App.
• Analytics, diagnostics, and crash-reporting providers that help us understand performance and fix technical issues.
• Subscription and purchase service providers, including Apple, that process transactions and confirm subscription status.
• Authorities or professional advisers when disclosure is required by law, necessary to protect rights and safety, or needed to investigate abuse.

We may also transfer information as part of a merger, acquisition, financing, reorganization, or sale of assets, subject to appropriate confidentiality and privacy protections.

6. Purchases and Subscriptions

In-app purchases and subscriptions are processed by Apple through the App Store. We do not directly receive or store your full payment card information.

We may receive limited transaction information, such as subscription status, product identifier, purchase validation information, and entitlement status, to unlock paid features and provide customer support.

You can manage or cancel subscriptions through your Apple ID subscription settings. Apple's processing of payment and account information is governed by Apple's applicable terms and privacy policy.

7. Data Retention

We retain information only for as long as reasonably necessary to provide the App, complete the requested AI processing, maintain security, comply with legal obligations, resolve disputes, and enforce agreements.

Images and prompts sent for AI processing may be retained temporarily by us or our service providers for processing, security, troubleshooting, or abuse prevention. Retention periods may vary depending on the provider and the nature of the service.

Images saved to your device remain under your control and may be deleted using your device's photo management features.

8. Data Security

We use reasonable administrative, technical, and organizational safeguards designed to protect information from unauthorized access, disclosure, alteration, loss, or misuse. These safeguards may include encrypted network transmission, access controls, and limited provider access.

No internet transmission or storage system can be guaranteed to be completely secure. You use the App and submit content at your own discretion.

9. Your Choices and Rights

Depending on your location, you may have the right to:

• Request access to personal information associated with you.
• Request correction or deletion of eligible information.
• Object to or restrict certain processing activities.
• Withdraw consent where processing is based on consent.
• Request a portable copy of eligible information.
• Submit a complaint to an applicable data protection authority.

You can control camera and photo-library permissions through iOS Settings. You may also stop further processing by discontinuing use of the App.

10. Children's Privacy

The App is not directed to children under the age of 13, or the minimum age required by applicable law. We do not knowingly collect personal information from children without appropriate authorization.

If you believe a child has provided personal information through the App, please contact us so we can review and take appropriate action.

11. International Processing

Our service providers may process information in countries other than the country where you live. Data protection laws in those countries may differ from those in your jurisdiction.

Where required, we take reasonable steps to use appropriate safeguards for international data transfers.

12. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes to the App, our data practices, technology, legal requirements, or service providers.

When we update this policy, we will revise the effective date shown at the top of this page. Material changes may also be communicated through the App or by other appropriate means.
